1. Introduction and Acceptance

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and FNG Applied Engineering Services LTD, a company registered in Nicosia, Cyprus, operating the ParkInTown smart parking management platform, the ParkInTown airport parking service at Larnaca International Airport, the ParkInTown proposal generator, the ParkInTown CRM, and associated web properties (collectively, "ParkInTown", "we", "us", or "our").

By accessing or using any ParkInTown service, including but not limited to entering a parking facility equipped with our ANPR cameras, booking airport parking with our valet service, downloading or using our mobile application, using our operator dashboard, requesting a commercial proposal, or submitting a job application through our careers page, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use our services.

These Terms apply in addition to our Privacy Policy, which governs how we collect and process your personal data. Please review both documents carefully.

We reserve the right to modify, suspend, or discontinue any part of our Services at any time, with reasonable notice where practicable. We are not liable for any modification, suspension, or discontinuation of Services.

4. User Accounts and Eligibility

To create a ParkInTown account, book the Airport Parking Service, or submit a job application, you must:

We reserve the right to suspend or disable your account if we reasonably believe that you have violated these Terms, provided false information, or engaged in fraudulent activity. We will provide notice and an opportunity to remedy the issue where circumstances permit.

5. Payment Terms

5.1 Parking Fees

Parking fees are determined by the Facility's posted rates and your parking duration as recorded by our ANPR system, or, for the Airport Parking Service, by the booked tier, pickup date, and return date. Fees for automated Facilities are calculated automatically upon vehicle exit. Fees for the Airport Parking Service are calculated at the time of booking and confirmed in writing before vehicle handover.

5.2 Payment Methods

Payments may be made through the App using credit cards, debit cards, or supported digital wallets. For Airport Parking Service bookings, additional payment channels may be available at the time of booking. You authorize us to charge your registered payment method for all parking fees incurred. All payment processing is handled by PCI DSS-compliant third-party payment processors.

5.3 Failed Payments

If a payment fails, we will notify you and may restrict your access to Services until the outstanding balance is resolved. Repeated payment failures may result in account suspension. For Airport Parking Service customers, a vehicle will not be released until all outstanding fees (including any overstay charges) are settled.

5.4 Refunds and Disputes

If you believe a charge is incorrect, you may dispute it by contacting us at hello@parkintown.io within 30 days of the transaction. We will review your dispute and respond within 14 business days. Refunds, if approved, will be credited to the original payment method. Airport Parking Service cancellation and refund rules are set out in the booking confirmation.

5.5 Taxes

All fees are inclusive of applicable VAT unless otherwise stated. We are responsible for remitting applicable taxes to the relevant authorities.

5.6 Operator Payment Terms

Payment terms for Operators are governed by the separate Service Agreement between ParkInTown and the Operator. Revenue settlements, commission structures, and payment schedules are as specified in that agreement.

6. ANPR Data Usage

6.1 How ANPR Works

Our ANPR cameras automatically capture images of vehicle license plates upon entry to and exit from participating Facilities. The system extracts the plate number, records the timestamp, and uses this data to manage parking sessions and calculate fees.

6.2 Purpose of ANPR Data Collection

ANPR data is collected and processed for the following purposes:

6.3 Your Rights Regarding ANPR Data

Even if you do not have a ParkInTown account, your vehicle's license plate is captured when entering a participating Facility. You may exercise your data protection rights as described in our Privacy Policy, including the right to object to ANPR processing, request access to your data, or request erasure.

Signage at each Facility entrance informs visitors that ANPR cameras are in operation and directs them to this policy and our Privacy Policy for further information.

7. ParkInTown Airport Parking (Valet Service)

This section applies to all Customers who book the ParkInTown Airport Parking Service at Larnaca International Airport. It supplements the general terms above and, in case of conflict regarding the Airport Parking Service, prevails.

7.1 Custody and Bailment

When you hand over your vehicle and keys to a ParkInTown driver at the airport curb, you place the vehicle into our custody as a bailee for reward. We assume responsibility for the safe custody of the vehicle and its keys from the moment of handover at the airport curb until the moment we return the vehicle and keys to you at the agreed pickup location. You remain the legal owner of the vehicle at all times.

7.2 Vehicle Inspection and Photo-Log

At drop-off, our driver will conduct a brief walkaround inspection and photograph the vehicle using our photo-log application. Any pre-existing damage or condition issues will be recorded. You may request to review the photos before leaving the curb. At pickup, we will photograph the vehicle again to establish its condition at the moment of return. These photos form the authoritative record for any damage claim.

7.3 Authorized Use Only

Our drivers are authorized to drive your vehicle only along the direct route between the airport and our parking lot. No detours, personal use, passenger transport, or commercial use is permitted. Smoking is not permitted in any customer vehicle at any time. All drivers operate under these rules without exception, and a continuously-recording dashcam may be present in every vehicle movement.

7.4 Service Level

We aim to respond to inbound pickup requests within a 15-minute service-level commitment from the time you notify dispatch that you have collected your baggage and are ready for pickup at the arrivals curb. In peak hours, airport congestion, adverse weather, or public-holiday traffic may cause delays beyond our control. We will keep you informed where any material delay occurs.

7.5 Flight Information and Schedule Changes

You are responsible for providing accurate flight information at the time of booking, including flight number, scheduled departure date, and scheduled return date. Should your flight be delayed, rescheduled, or cancelled, you must notify dispatch as soon as reasonably practicable via the phone or messaging channel communicated in your booking confirmation. Failure to notify us of a schedule change may result in delayed pickup or additional storage charges.

7.6 Items Left in the Vehicle

We recommend that you remove all personal belongings, valuables, documents, electronic devices, and cash from the vehicle before handing it over. We cannot be held responsible for the loss, damage, or theft of any item left inside the vehicle unless such loss is directly caused by our negligence. No items representing contraband, illegal substances, hazardous materials, firearms, or live animals may be left in any vehicle placed in our custody.

7.7 Liability During Custody

We carry appropriate commercial insurance for vehicles in our custody. In the event of damage to your vehicle during our custody that is directly attributable to our driver or operational failure, we will coordinate with our insurer to process a claim. Our liability for any such damage is limited to the lower of (a) the cost of repair using standard market rates in Cyprus, or (b) the fair market value of the vehicle at the time of the incident. We are not liable for damage caused by force majeure events, third-party acts beyond our reasonable control, or pre-existing conditions documented at drop-off.

7.8 Late Collection and Overstay

If you do not collect your vehicle within 24 hours of the booked return time and have not notified us of a schedule change, we will hold the vehicle securely at our lot and attempt to contact you using the details on your booking. Additional daily storage charges at the rate published in your booking confirmation will apply. Vehicles uncollected after 30 days will be handled in accordance with Cyprus abandoned-property law.

7.9 Tips

We operate a tip-share pool across our driver team. Individual cash tipping at the curb is discouraged in favor of a fair distribution mechanism that rewards the whole service chain. Tips are optional and do not affect the quality of service you receive.

8. Proposal and Business Intelligence Services

8.1 Who this applies to

This section applies to Operators and Prospects who request, receive, or review a commercial proposal prepared through our Proposal Services. It does not apply to Drivers or Airport Parking Customers.

8.2 How proposals are generated

Our proposal generator produces tailored commercial offers using a multi-step drafting pipeline that includes artificial-intelligence language models and other automated tooling operated by ParkInTown. All processing takes place on GDPR-compliant servers located in Europe and under our direct control. Your business information (company name, facility details, operational context, contact data) is processed through this pipeline to produce a branded written proposal and a corresponding PDF document. See our Privacy Policy for details on how we handle this information.

8.3 Nature of the proposal

Proposals generated through our Proposal Services are commercial offers issued in good faith based on the information you provide and on publicly available market data. They are not legally binding contracts until both parties sign a definitive Service Agreement. Figures in proposals, including projected revenue uplifts, occupancy improvements, or cost savings, are estimates based on benchmarks and historical data; actual results depend on many factors outside our control.

8.4 Confidentiality

Proposals and any related business intelligence documents shared with you are confidential. You agree not to disclose their contents to third parties without our written permission, except to your own professional advisors on a need-to-know basis.

9. Job Applications and Recruitment

9.1 Applying for a position

When you submit a job application through our careers page or by other means, you voluntarily provide us with personal and professional information, which may include your name, email, phone number, LinkedIn profile, cover letter, and resume (CV) file. By submitting an application you confirm that the information is accurate, that the resume and any supporting files are yours to share, and that you have the right to do so.

9.2 Use of application data

We use application data exclusively to evaluate your suitability for open and future positions at ParkInTown, to contact you about your application, and to conduct reference or background checks where permitted by Cyprus labour law and with your specific consent. Application data is retained only for as long as necessary for these purposes, as set out in our Privacy Policy.

9.3 No guarantee of employment

Submitting an application does not create any employment relationship, offer, or promise of employment. All hiring decisions are at our sole discretion and subject to applicable Cyprus labour law.

9.4 Withdrawal

You may withdraw your application at any time by contacting us at hello@parkintown.io, in which case we will delete your application data within a reasonable period except where retention is required by law.

10. Acceptable Use

When using our Services, you agree not to:

Violation of this acceptable use policy may result in immediate suspension or termination of your account and access to our Services, and, for the Airport Parking Service, in the immediate release of your vehicle to you at your own expense at the earliest practical time, without prejudice to any other remedies available to us.

11. Intellectual Property

11.1 Our Intellectual Property

All intellectual property rights in the ParkInTown platform, including but not limited to the App, Dashboard, ANPR software, airport dispatch and photo-log systems, proposal generator pipeline, algorithms, user interfaces, designs, trademarks, logos, and content, are owned by or licensed to FNG Applied Engineering Services LTD. These rights are protected by Cyprus, European Union, and international intellectual property laws.

11.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use our App and Services for their intended purpose, subject to these Terms. This license does not include the right to:

Commercial proposals we deliver to Operators and Prospects remain our intellectual property. You may share them internally within your organization and with your professional advisors for evaluation purposes. Any wider distribution or reuse of the drafted text, figures, or templates requires our written consent.

11.4 User Content

To the extent you provide any content to us (such as feedback, suggestions, support communications, or voluntary photos), you grant us a non-exclusive, royalty-free, worldwide license to use that content for the purpose of operating and improving our Services.

12. AI-Generated Content Disclaimer

Certain parts of our Services, including but not limited to the Proposal Services and internal workflow tools, use artificial-intelligence language models to draft text, summarize data, or generate commercial documents. AI-generated content is produced from the information available at the time of generation and may contain inaccuracies, omissions, or errors.

All AI-generated commercial proposals are reviewed by our team before being sent to Operators or Prospects, but you should treat any projected figure, benchmark, or claim as an estimate subject to confirmation in a definitive Service Agreement. No AI-generated content shall be treated as professional legal, tax, accounting, or financial advice. You are responsible for independently verifying any number or statement before relying on it for a commercial decision.

13. Disclaimers and Limitation of Liability

13.1 Service Availability

We strive to provide reliable and uninterrupted Services but do not guarantee that our Services will be available at all times. Our Services may be subject to temporary interruptions due to maintenance, upgrades, technical issues, or circumstances beyond our control (including power outages, network failures, airport operational events, or force majeure).

13.2 Disclaimer of Warranties

To the maximum extent permitted by applicable law, our Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. We specifically disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by applicable law, FNG Applied Engineering Services LTD, its directors, officers, employees, drivers, agents, and affiliates shall not be liable for:

Except for the dedicated Airport Parking Service custody liability set out in Section 7.7, our total aggregate liability for any claims arising out of or relating to these Terms or our Services shall not exceed the total fees you have paid to ParkInTown in the twelve (12) months preceding the claim.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.

You agree to indemnify, defend, and hold harmless FNG Applied Engineering Services LTD and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to:

16. Governing Law and Dispute Resolution

16.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Cyprus, without regard to its conflict of law principles. Where applicable, European Union regulations (including the GDPR) shall also apply.

16.2 Informal Resolution

Before initiating any formal dispute resolution proceedings, you agree to first contact us at hello@parkintown.io and attempt to resolve the dispute informally within 30 days.

16.3 Mediation

If informal resolution is unsuccessful, either party may propose mediation through a mutually agreed mediator in Nicosia, Cyprus. The costs of mediation shall be shared equally between the parties unless the mediator directs otherwise.

16.4 Jurisdiction

If mediation is unsuccessful or not pursued, any disputes arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of Nicosia, Republic of Cyprus.

16.5 EU Consumer Rights

If you are a consumer within the European Union, nothing in these Terms affects your statutory rights under applicable EU consumer protection laws. EU consumers may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

17. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

Your continued use of our Services after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree with the revised Terms, you must stop using our Services and close your account.

18. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

The failure of either party to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
